As part of your contract with Global Online Electronic Services (GOES), you agree to abide by the terms and conditions posted on this Policies Page. Should, for any reason, you fail to comply with these rules, GOES maintains the right to terminate your account.
If you do not agree to comply with these terms, please notify Sales@goes.com so that we may cancel your service and give you a prorated refund if applicable.

Terms and Conditions
1. Global Online Electronic Services, Inc.(“Global”) exercises no control whatsoever over the content of the information passing through its network. 

Global makes no warranties of any kind, whether expressed or implied, for the service it is providing. Global also disclaims any warranty of merchantability or fitness for a particular purpose. Under no circumstances will “Global” be responsible for any incidental, special, or consequential damages you suffer. This includes loss of data resulting from delays, mistakes, omissions, file deletions, defects, non deliveries, mis deliveries, or service interruptions caused by its own negligence or your errors or omissions, whether or not caused by events beyond “Globals” reasonable control, including but not limited to acts of God, line failure, theft or destruction of equipment, or the result of unauthorized “hacking” of the “Global” network.

Use of any information obtained via Global’s network is at your own risk. Global specifically denies any responsibility for the accuracy or quality of any information obtained through its services. The subscriber alone is responsible for monitoring any and all information that may be deemed unsuitable for children which may be accessed through their “Global” account.
Global specifically denies any responsibility for damages you may suffer because of the inability to access any Internet site or email from any Internet site either from Global banning the site or the site banning Global.

In any event, the total liability to “Global” for any or all losses, damages, or causes of action shall not exceed the aggregate dollar amount paid under the term agreement.

2. Customer’s use of the host computers and points of presence (the “Network”) of Global may only be used for lawful purposes.

Any material in the available in the ‘public domain’ (images, text, shareware or “legally” obtained programs) may be transmitted through the “Global” services. Any materials in the public domain may also be re-distributed. The subscriber assumes all risks regarding determination of the materials public domain status.

Transmission of any material in violation of any US or state regulation is prohibited. This includes but is not limited to: copyrighted material, material legally judged to be threatening or obscene (including child pornography), any involvement, no matter the type, in drug trafficking, or material protected by trade secret. You agree to indemnify and hold harmless Global from any claims resulting from your use of the service or the use of the service by any of your customers or others throughout your chain of distribution, including end users, which damages another party.

The use and or storage of programs or tools which may tamper with or damage any part of the ” Global” network or it subscribers is strictly prohibited. (examples: viruses, trojans, password or code ‘cracking’ tools, network probing tools)

Failure to abide by the the rules set forth in this section could subject the subscriber to criminal or civil liability.

3. Personal accounts are only allowed to be used for non-commercial activities.

Business accounts are only allowed to be used by the business whose name is indicated on the account application form. Under no circumstances are Internet access or services allowed to be resold or made available to a third party without the expressed written consent of Global Online.

4. System abuse is strictly prohibited.

Global Online may terminate service immediately and may bill for any resulting charges if the client engages in system abuse. Following is a list of actions which are defined to be system abuse. This list is non-exclusive; any action about which there is any doubt should be referred to Global Online for evaluation. Actions which constitute abuse include, but are not limited to:

  • Attempting to circumvent user authentication or security of any host, network, or account on Global Online’s systems or the Internet at large through the use of ‘packet sniffers, password crack programs or other similar programs/methods is strictly prohibited.
  • Attempting, in any way, to interfere with or deny service to any user or any host in the Internet
  • We have set limitations on disk space and initiated idle time outs for the good of all dial up accounts. Attempts to bypass these limitations will result in immediate account termination.Abuse of e-mail and/or newsgroups1) forwarding or posting “chain letters” (multiple forwarding) of any type
    2) sending large numbers of unsolicited mail messages (i.e. “junk mail”)
    3) engaging in harassment, whether through language, frequency, or size of messages
    4) posting inappropriate messages to USENET newsgroups e.g., posting large numbers of unsolicited posts indiscriminately (“spamming”), or posting encoded binary files to USENET newsgroups not specifically named for that purpose
    5) attempting to cancel, supersede, or otherwise interfere with email or USENET posts other than one’s own.
    6) forging email or USENET posting header information 

    Activities such as the transfer of information or solicitation of persons via the internet in attempt to extort money or valuables or the use of chain/pyramid letters are illegal and prohibited.

    The servers for personal sites are specifically set for low traffic volume. Personal web sites which intentionally or unintentionally draw excessive traffic, will, at the discretion of &Global& be put on review and possibly moved to a commercial server. At such time, it would be up to the subscriber to decide whether to limit the site content and traffic or pay for a commercial site.

    Using an account at another provider to promote a Global Online Web site in an abusive manner.

    Using a Global Online account to collect replies to messages sent from another provider which violate these rules or those of that provider.

    The use of any unauthorized software applications (ex: IRC Bots, HTTP Servers, MUDS, PPP/SLIP emulators) Any such software found will automatically be removed from Globals servers.

    Sharing of accounts for the purpose of avoiding a second is strictly prohibited.

    Software theft or the illegal exchange of software over the internet for purposed of avoiding licensed purchase of copyrighted software such as Adobe PhotoShop, Microsoft Office Suite etc. is illegal and prohibited. This also includes, but not limited to unauthorized reproduction or digitization and distribution of photographs from any copyrighted media.

    5. Payment is due upon receipt of invoice.

    The subscriber acknowledges, and agrees to assume full accountability for all charges against his/her account, and for making timely payments against all charges.

    Accounts are overdue if payment is not received within 30 days after date of invoice. Any overdue account may have their service interrupted without notice. A reconnect fee of $17.95 may be accessed to reconnect service following interruption. Such interruption does not relieve you from the obligation to pay the monthly charge.

    Should a subscriber wish to cancel an account, the request must be made in writing, including the subscribers login name to:

    Non-usage of an account is not proof of cancellation. Only a written request to terminate your service relieves you of your obligation to pay the monthly account charge.

    Any billing discrepancies must be made in writing within 20 days of the billing date. These claims must be submitted in the same manner as the cancellation request discussed above. No claims will be honored if made more than 20 days after the invoice date. Should any claims be made after such time, they will be deemed invalid.

    In the event of a billing claim, the invoice must still be paid while the claim is investigated. Reimbursements will be made if applicable.

    A fee of $50 will be charged for personal or business checks returned to Global as unpaid. Any amount unpaid and carried forward to the following month’s invoice will be assessed a late fee equal to the greater of $5.00 or 1.5% of the balance brought forward. If you default, you agree to pay Global its reasonable expenses, including attorney and collection agency fees, incurred in enforcing its rights to these Terms and Conditions.

    6. Billing for your Global service will normally commence when the first authenticated access to the Global service has been completed.

    In the event of early cancellation of any Term Commitment, the customer will be charged the standard monthly charge for any months used on the Term. Global reserves the right to change the rates by notifying you 30 days in advance of the effective date of the change.

    7. These Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any other order submitted.

    Use of Global’s network constitutes acceptance of these Terms and Conditions. Global reserves the right to terminate any account immediately that is in violation of any term or condition.

    8.Network Accessibility Claims

    If Customer notifies Global immediately upon failure to access the Network and Global determines in its reasonable commercial judgment that the Network is unavailable to Customer, the following will apply: If Global so determines that the Network is unavailable for four (4) or more consecutive hours during any calendar month, Global upon Customer’s request, will credit Customer’s account for such month the pro-rated charges for one (1) day’s access. Or if Global so determines that the Network is unavailable for an aggregate of eight (8) or more such hours during any calendar month, Global upon Customer’s request, will credit Customer’s account for such month for the pro-rated charges for one (1) week’s access. Scheduled maintenance shall not be deemed to be Network unavailability. This paragraph states Global’s sole obligation and Customer’s exclusive remedy for any Network unavailability.

    9.Local Dialup Access

    The Customer is responsible to research and confirm that the Global Online Phone Number they are calling is local for them. Global Online is not responsible for long distance phone charges on the customers phone bill whether they are calling the server or the Global Office for technical support.

    In the event of downtime for the local dialup – should the subscriber choose a long distance access number, even at the direction of the GOES Technical Staff, the subscriber remains responsible for the long distance charges.

    WARNING: WE DO NOT WARRANT OR PROMISE THAT ANY OF THE FOLLOWING NUMBERS ARE LOCAL TO YOU. IN PARTICULAR, WE URGE YOU TO NOTE THAT EVEN AN ACCESS NUMBER THAT SHARES YOUR AREA CODE OR APPEARS TO BE LOCATED IN YOUR GENERAL GEOGRAPHIC REGION MAY NOT NECESSARILY BE A LOCAL NUMBER TO YOU. SUBSTANTIAL TOLL TELEPHONE CHARGES MAY APPLY TO NUMBERS THAT YOU DO NOT VERIFY AS LOCAL TO YOUR INDIVIDUAL AREA OR CALLING PLAN.

    YOUR LOCAL TELEPHONE COMPANY CAN TELL YOU WHETHER ANY OF THE BELOW TELEPHONE NUMBERS ARE IN FACT LOCAL TO YOU. WE URGE YOU TO CHECK WITH YOUR LOCAL TELEPHONE COMPANY BEFORE SELECTING A NUMBER FROM BELOW.

    10.Global Online Electronic Services makes no claims on availability of login names, e-mail addresses or web page addresses.

    These names are not confirmed at time of signup for any subscriber. Global is not responsible for any charges due to misprinted material of any sort or of any losses incurred.

    Acceptable Use Policy
    This Acceptable Use Policy specifies the actions prohibited by Global Online Electronic Services, Inc. (“GOES”) to users of the GOES Network. GOES reserves the right to modify the Policy at any time, effective upon posting the modified Policy here

    ILLEGAL USE. The GOES Network may only be used for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

    SYSTEM AND NETWORK SECURITY. Violations of system or network security are prohibited, and may result in criminal and civil liability. GOES will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following:

    • Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owners of the system or network.
    • Unauthorized monitoring of data or traffic on any network or system without express authorization of the owners of the system or network.
    • Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.
    • Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

    EMAIL. Sending unsolicited mail messages, including without limitation, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site’s mail server to relay mail without the express permission of the site.

    USENET. Posting the same or similar message to one or more newsgroups (excessive cross-posting or multiple-posting, also known as “SPAM”) is explicitly prohibited.

    INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A GOES CUSTOMER OR A CUSTOMER’S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.

    Complaints regarding Illegal Use or System or Network Security issues should be sent to security@goes.com.

    Complaints regarding email abuse should be sent to fraud@goes.com.

    Complaints regarding USENET abuse or SPAM should be sent to spam-complaint@goes.com.Global Online Electronic Services (GOES) maintains the right to redefine its policies at any time. GOES, Global, Global Online and Global Online Electronic Services are one in the same and should be considered as such.
